1. Scope of Warranty:

Radon Response Canada warrants to the original homeowner and any subsequent owner of the property at the System Address (hereinafter referred to as the "Owner") that the installed Active Soil Depressurization (ASD) system (hereinafter referred to as the "System") will maintain a 90-day average radon level within the treated area(s) of the property below 100 Becquerels per cubic meter (Bq/m³) of air for a period of five (5) years from the Effective Date, under normal conditions of use and occupancy.

This warranty covers defects in workmanship and materials of the System components installed by Radon Response Canada, including, but not limited to:

●      Piping and fittings

●      Fan unit

●      Manometer or other pressure indicating device

●      Wiring directly associated with the System installation

2. Transferability:

This warranty is fully transferable and will automatically apply to subsequent owners of the property at the System Address for the remaining duration of the five-year warranty period.

3. Radon Level Testing and Verification:

●      Initial Post-Mitigation Test: Radon Response Canada has provided the homeowner with a continual radon monitor and has not invoiced for the system installation until the homeowner has reported a seven-day average radon level below 100 Bq/m3.

●      Owner Responsibility: The Owner is responsible for conducting radon testing to verify radon levels during the warranty period. It is recommended that the Owner conduct a radon test at least once every two (2) years. The Owner shall use a radon test kit that is certified for use in Canada or hire a radon measurement professional certified by the Canadian National Radon Proficiency Program (C-NRPP).

●      Warranty Claim Procedure: If the Owner conducts a radon test using a certified radon testing professional or a recognized do-it-yourself test kit following the manufacturer's instructions, and the results indicate a 90-day average radon level equal to or exceeding 100 Bq/m³ in the treated area(s), the Owner must notify Radon Response Canada in writing within thirty (30) days of receiving the test results. The notification must include a copy of the complete test report, including testing dates, location(s) of testing, and the testing protocol used.

4. Warranty Claim Resolution:

Upon receipt of a valid warranty claim and test results indicating radon levels at or above 100 Bq/m³, Radon Response Canada will, at its sole discretion, take one of the following actions within a reasonable timeframe:

●      Inspect and Repair: Radon Response Canada will inspect the System and perform any necessary repairs or adjustments to restore the System's functionality and reduce radon levels below 100 Bq/m³. All labour and materials for such repairs will be covered under this warranty.

●      System Enhancement: If repairs are insufficient to reduce radon levels below 100 Bq/m³, Radon Response Canada may enhance the existing System, which may include adjustments to suction points, increasing fan power (if feasible and safe), or other appropriate modifications.

●      System Replacement: In the event that repairs and enhancements are deemed insufficient to achieve the warranted radon level, Radon Response Canada will replace the defective components of the System with comparable new components.

5. Exclusions and Limitations:

This warranty does not cover:

●      Radon level increases due to structural changes, additions, renovations, or alterations to the property after the System installation that may affect airflow or soil gas pathways. This includes, but is not limited to, the addition of a basement, changes to the foundation, or significant landscaping changes.

●      Damage to the System caused by acts of God, natural disasters, accidents, misuse, neglect, vandalism, or unauthorized modifications or repairs.

●      Routine maintenance of the System, including, but not limited to, cleaning debris from vent pipes, ensuring the fan is operating (unless the fan failure is due to a defect in materials or workmanship within the warranty period), and checking the manometer.

●      Costs associated with radon testing performed by the Owner.

●      Radon levels in areas of the property that were not intended to be mitigated by the installed System.

●      Noise or aesthetic concerns related to the normal operation of the System.

●      Electrical issues not directly related to the original System installation.

●      Any pre-existing conditions that were not disclosed and could affect the system.

6. Limitation of Liability:

The liability of Radon Response Canada under this warranty is expressly limited to the repair, enhancement, or replacement of the System as described herein. Radon Response Canada shall not be liable for any incidental, consequential, or indirect damages, including, but not limited to, costs of temporary relocation, lost income, or health-related claims, arising from radon exposure or the malfunction of the System.

7. Governing Law:

This warranty shall be governed by and construed in accordance with the laws of the Province of Manitoba, Canada.

8. Entire Agreement:

This document constitutes the entire warranty agreement between Radon Response Canada and the Owner regarding the radon mitigation performance of the installed System and supersedes all prior or contemporaneous communications and proposals, whether oral or written.
